AI outbound calling is the use of a voice AI agent to place phone calls, talk with the person who answers and record what happened. Unlike a prerecorded robocall, the agent listens and responds: it answers questions, confirms or changes an appointment, books a meeting or transfers to your team.

Is AI Cold Calling Legal?

AI cold calling to people who haven't agreed to hear from you is restricted in many markets and, in the US, generally not allowed without prior consent. That is why Aaga builds AI outbound calling for consented and expected calls, not for mass dialing of purchased lists. The rules below are a general overview, not legal advice. United States

  • TCPA and AI voices. In 2024 the FCC confirmed that AI-generated voices count as "artificial" voices under the Telephone Consumer Protection Act. Calls using them generally need the called party's prior express consent, and telemarketing calls generally need prior express written consent.
  • Do-not-call lists. Marketing calls must respect the National Do Not Call Registry and your own internal do-not-call list.
  • Calling hours. Federal rules limit telemarketing calls to set hours in the called party's local time, and several states set narrower windows or extra rules.
  • Identification and opt-out. Artificial-voice calls must identify the business, and marketing calls must offer a way to opt out.

India

  • TRAI regulations. Commercial calls are governed by TRAI's rules on unsolicited commercial communication, including sender registration on the DLT platform and designated number series for promotional and service calls.
  • DND preferences. Promotional calls must respect customers' do-not-disturb choices registered with their telecom operator.
  • Data protection. The Digital Personal Data Protection Act, 2023 sets consent and purpose rules for the personal data you use to call.
